Jim Mirkalami - the Email Problem and the Court Case gets serious

The trail of replies in the next episode of the historical battle between the spammer and the blogger continues.

Here's what he had to say.

Sorry about the email problem, that was indeed an error on my side.

Kindly refrain from publication of the name "Jim Mirkalami" and remove any
and all references made to it from you website/s and blogs.

The purpose of my communication with you and other online community members
is to make it clear that my name was used in error and without authorization
and I happened to have an un-common name, like yours, that could not be
misunderstood with someone else.

I would appreciate your understanding and cooperation.

Mr.Mirkalami,

Please try and understand that the name referred to doesn't in any way refer to you or your identity and hence doesn't/shouldn't affect you or bring any ill fame to your name.

My blog serves as a service to the online community and all posts here are to make aware of the online activities, good or bad. "Jim Mirkalami"s spam incident has been an outrage which needs to be made aware.

If someone might be using your name as fake, the prime objective should be to trace down the spammer, rather than bringing down posts which are spreading the news that it's a spammer.
I hope if anyone even uses a name like Michael Arrington (I believe you know who he is ), we wouldn't spare him if he were to spread spam, irrespective of the real identity of who Mr.Arrington is. This goes without saying that Mr.Arrington's name has been brought into picture, but no one in the whole world would believe that Mr.Arrington would ever indulge in spam activities.

So the news would be of someone faking as Michale Arrington , or in this case your name. How does the removal of your name from the posts bring any solution to this problem is out of my comprehension.

A last question though- You have now mailed me from yet another mail ID of a website which is a wireless, HDTV and cable TV provider.What exactly are you and can we get to know your identity if that is not a problem?

Your theory would have been correct if, there were more than one (1) “Jim Mirkalami” in this world, whom happened to be a “Single Father” whom happened to have a brother by the name of Seyed. However that is not the case.

Since there is only one (1) Jim Mirkalami in this universe and that is “I”, I do have exclusive right to this name and its use.

While your blog is a great service to many, it is currently damaging to a person and in violation of many civil and privacy laws and, reading your entire blog, frankly projection of your imagination, slander and assault. And quite frankly the outrage over a comment that reads “ I have been reading your blogs and now I’d like to say thank you” or something like that by someone who actually reads a lot of blogs but decided to use my name without asking is quite un-just.

There is now ample information available to you regarding this matter, a credit card company or a bank would not hold me responsible if someone else used my credit card without my authorization nor would they ask me to go after the person who used it without my authorization.

Imagine a murderer printing “Jim Mirkalami” on the seen of the crime, should the police prosecute the true criminal by its fake name “Jim Mirkalami”!

I have no idea who Micheal Arrington is and I don’t believe that application would apply here.

I am not sure what your last question means however assuming you may not know this: ROGERS is the only cable TV provider in Eastern Canada, it also provides internet service and if you are a Rogers Internet subscriber your personal email address would contain the word “Rogers”. If I were a Bell Canada Internet subscriber my personal email would have been jimmirkalami@bell.ca or something like that, that’s all.

And by the way jim@heritageinternational.ca is my email address assigned to me at work, the server has been down for the last few days and I simply forgot to change the “from” to my personal email address.

Once again, first and for most, thank you for taking the time and replying to my email, I’d like to request once again, please remove any and all contents in your blog containing the name “Jim Mirkalami”.

I have communicated this to the other web site owners who have chosen the path of slander and assault, some have been co-operating, some I have commenced legal action against and the rest I will be taking legal action against as of Monday April the 7th, 2008.

I have reported this matter to google and yahoo and have been advised to contact the webmasters first, if no resolution achieved then report the matters to a civil court in order to obtain a court order.

My case is simple; I will be seeking an order in a Canadian Civil Court directing google and yahoo removing such pages from their search results.

I wish I do not have to take that rout with you to clear my name.

It seems it is more serious than what I had thought it to be. But
don't you think that rather than removing these posts and topics
discussing the whole event, it would be better if there were an entire
mail describing your end of the tale which would rectify the entire
confusion regarding "Jim Mirkalami". If you'd like to use my blog as a
platform to do so, I would certainly be pleased to help you out with
that. However, if you still want to stick with your decision that your
name be removed from all the posts on my blog, please let me know in
your reply.

However, we all would appreciate if you take care of your brother
Seyed and his further online activities. I know this chapter has been
just blown out of proportion.

I appreciate your offer, I will be pleased to send the message across via
your blog however, for the time being due to an ongoing legal action in
Quebec I will not be able to speak on the subject. That trial is expected to
take place in December 2008.

It would be greatly appreciated if you did remove the current references to
“Jim Mirkalami” and after the court case in December I will gladly offer my
thoughts on this issue and fill in the blanks the best I can in your blog.

Seyed is a good-hearted person however very simple minded and unfortunately
suffering from a mental illness known as “Schizophrenia”. I have made sure
that he understands his actions were inappropriate and rest assured that
will not repeat.

Mr. Mirkalami does seem to have a lot of patience regarding emailing back to the scores of people who have written about the incident and even attending to them personally. Bravo!
